Terms & conditions
These Terms & conditions set out the baseline rules for using the Supernova design & communication Sàrl website, and for design, communication and creative-service engagements where no separate written agreement applies.
1. Scope
These Terms & conditions govern access to the website and, where no separate written agreement applies, the initial relationship between Supernova design & communication Sàrl (“the studio”) and prospective clients. Project-specific proposals, statements of work, or signed agreements take precedence over these general terms where they conflict.
2. Studio services
The studio may provide brand identity, art direction, digital design, web design, editorial systems, campaign design, prototyping, and creative consulting. The scope, milestones, deliverables, assumptions, fees, and timeline for each engagement should be confirmed in writing before work begins.
3. Client responsibilities
The client is responsible for providing accurate information, source materials, approvals, feedback, and access needed for the project. Delays in feedback, missing assets, changed requirements, or unavailable stakeholders may affect the schedule and may require a revised fee or timeline.
4. Fees and payment
Fees, deposits, payment stages, and due dates should be defined in the relevant proposal or invoice. Unless otherwise agreed, the studio may pause work or withhold final deliverables if invoices remain unpaid after the agreed due date.
5. Intellectual property
Unless a written agreement states otherwise, concepts, drafts, working files, methods, and unused proposals remain the property of the studio. Final rights granted to the client apply only to approved deliverables after full payment has been received and only within the agreed scope of use.
6. Portfolio use
The studio may reference completed work, client names, and approved visuals in portfolios, case studies, award submissions, social channels, and credentials presentations, unless confidentiality or launch restrictions have been agreed in writing.
7. Third-party materials
Fonts, stock imagery, software, hosting, plugins, production services, and other third-party materials may be subject to separate licences or terms. The client is responsible for fees and ongoing compliance for third-party assets unless otherwise agreed.
8. Liability
To the extent permitted by applicable law, the studio is not liable for indirect, incidental, consequential, or loss-of-profit damages arising from the website or services. Any total liability connected with a project should be limited to the fees paid for that specific project, unless mandatory law requires otherwise.
9. Governing law
Unless otherwise agreed in writing, these terms are governed by Swiss law. The competent courts at the studio’s Swiss place of business should have jurisdiction, subject to mandatory legal venues.
10. Updates
The studio may update these Terms & conditions from time to time. The latest version published on the website applies from the date shown above, subject to any signed agreement already in force.
